1.1These Terms apply to membership in the Kiwi.com Club (“Kiwi.comClub”). Our Terms & Conditions along with the Terms of Use and the T&Cs of the relevant third parties (e. g. carriers) will apply to your bookings.
1.2The provider of the Kiwi.com Club is Kiwi.com s.r.o., with a registered office at Rohanské nábřeží 678/25, 186 00, Prague 8-Karlín, Czech Republic, Company ID No.: 29352886, registered in the Commercial Register maintained by the Municipal Court in Prague, File No. C 387231, Tax ID No. CZ29352886 (“Kiwi.com”, “we”, “us” and “our”).
1.3When we refer to you as a member of Kiwi.com Club, we use the terms “member”, “you” and “your”.
2.How to become a member of Kiwi.com Club
2.1To become a member of the Kiwi.com Club, you must apply for the Kiwi.com Club, be signed in to your Kiwi.com account, and verify your Kiwi.com account and phone number.
2.2When applying for the Kiwi.com Club membership, use your name and surname as stated in your travel document. You are allowed to change your name or surname once per year.
2.3To upgrade to Black Tier membership, you must have completed a minimum of four (4) Kiwi.com Club-eligible trips within the preceding 365 days, starting from when you joined the Kiwi.com Club. For the purposes of this requirement, the date of the last segment of each trip will be used as the reference date. Only bookings that include the Kiwi.com Guarantee or Kiwi.com Benefits and have been at least partially used (i.e., not canceled) are considered Kiwi.com Club-eligible. If you received early access to the Kiwi.com Club (as a Black Pilot member), Kiwi.com Club-eligible trips booked before joining the Club also count.
2.4Kiwi.com Club membership may be subject to additional conditions in the future. Being a Kiwi.com Club member does not automatically qualify you to remain a Kiwi.com Club member when new conditions take effect.
3.Benefits of the Kiwi.com Club
3.1Benefits for all Kiwi.com Club members
3.1.1Voucher drops. From time to time, we will run campaigns featuring voucher drops. As part of the Kiwi.com Club membership benefits, Kiwi.com will grant you access to promotional codes exclusive to Kiwi.com Club members. These codes can be applied during the checkout process to obtain discounts on eligible bookings. Each promotional code is available on a first-come, first-served basis and is valid for a specified number of uses. Once the maximum number of uses is reached, the code will no longer be available. The terms specified in Art. 12.9 of the Terms & Conditions, as well as any other terms related to the individual promotional codes, apply. You will be able to apply a promotional code only if you, as the member of Kiwi.com Club, are a passenger in the booking.
3.1.2Redirects to airline websites. When you search on the Kiwi.com platform for a single airline itinerary with no self-transfer and no bags, and we cannot match the airline’s price that we have access to, we will present you with two options for completing your booking: (i) booking with Kiwi.com, and (ii) redirecting to third-party websites. If you choose the redirect option, you’ll be taken to a different website to finalize your booking. In this case, Kiwi.com will not be part of your agreement or transaction. You will enter into a contract with the third-party service provider.
3.2Extra benefits for Black Tier members
3.2.1If you are a Black Tier member of Kiwi.com Club, you will get Kiwi.com Guarantee Refundable for the price of regular Kiwi.com Guarantee, or Kiwi.com Benefits Refundable for the price of regular Kiwi.com Benefits, for your future bookings. This means that on top of all benefits included in Kiwi.com Guarantee or Kiwi.com Benefits you will get the Refundability benefit for free, allowing you to cancel your booking under conditions defined in Art. 19.3 of our Terms & Conditions (hereinafter referred to as “Refundability benefit”).
3.2.2You will get the Refundability benefit only if you, as the Black Tier member of Kiwi.com Club, are a passenger in the booking.
3.2.3If you request name/surname change after completing a booking with the Refundability benefit, resulting in no passenger in the booking matching name and surname of the Black Tier member of Kiwi.com Club, the Refundability benefit will be removed from your booking.
3.2.4The Refundability benefit is only available for bookings made more than 4 hours before the first departure directly on the Kiwi.com platform (from search to payment), and not for bookings searched through meta search engines.
4.Fair Usage Policy for the Refundability benefit
4.1To ensure the availability and quality of our services for all Kiwi.com Club members, the complimentary Refundability benefit offered to Black Tier members is subject to a Fair Usage Policy
4.2Use of the Refundability benefit is limited to a maximum of two (2) cancellations per calendar month and a maximum of six (6) cancellations per calendar year.
4.3If you reach either the monthly or yearly limit, any subsequent cancellations made within that same calendar month or year will not be subject to the Guarantee Refundable or Kiwi.com Benefits Refundable terms. Instead, the terms of the Saver Fare type will apply to the cancellation and any potential refund will be processed according to the airline’s rules.
4.4Your eligibility for the Refundability benefit will automatically reset at the beginning of the next calendar month (if the monthly limit was reached) or the next calendar year (if the yearly limit was reached).
4.5If you request a cancellation under the Refundability benefit, in exchange for an upfront refund in Kiwi.com Credit equivalent to the airline ticket price of your flights (excluding Kiwi.com fees and any ancillary charges), you withdraw your right to exercise any rights related to the booking and assign to us all your rights, titles, and claims for refunds against the airlines arising from or related to the booking for which the cancellation was requested. If you accept the Kiwi.com Credit and then take any action that conflicts with the cancellation or makes it harder for us to recover a refund from the airlines, we may cancel the Kiwi.com Credit refund and/or terminate your Kiwi.com Club membership, as well as remove the Refundability benefit from your other existing bookings.
5.Cancellation of the Kiwi.com Club membership
5.1You can cancel your Kiwi.com Club membership anytime with immediate effect.
5.2Cancelling your Kiwi.com Club membership will not affect any bookings you have completed while being a member of Kiwi.com Club.
6.Termination of the Kiwi.com Club and change of these Terms
6.1Kiwi.com reserves the right to terminate Kiwi.com Club at any time with immediate effect.
6.2Such termination will not have any effect on the bookings that were completed prior to such withdrawal.
6.3Kiwi.com reserves the right to amend these Terms at any time and without prior consultation with members of the Kiwi.com Club. We will inform you about any changes to these Terms and give you the option to cancel your Kiwi.com Club membership.
7.Fraud and misuse of Kiwi.com Club benefits
7.1We may withhold, reverse, or invalidate any Kiwi.com Club reward or benefit (including vouchers and Kiwi.com Credit) if we reasonably suspect fraud, abuse, or misuse (including for commercial purposes), such as automated account creation or attempts to circumvent eligibility criteria or limits. We may also suspend or terminate your Kiwi.com Club membership and any affected accounts, cancel related bookings, and seek to recover losses where permitted.
8.Governing Law
8.1These Terms and any legal relations established under it or derived from it, shall be governed by the laws of the Czech Republic with the exclusion of any rules on conflict of laws. If you are a consumer, you additionally enjoy the standard of protection afforded to you by mandatory provisions of the law of your country of residence.
9.Dispute resolution
9.1Amicable dispute resolution. Prior to the commencement of any of the below methods of dispute resolution, please try to contact us through our contact form available at: www.kiwi.com/en/help/contact/ first to resolve any of your complaints or suggestions.
9.2Out-of-court dispute resolution. Prior to filing any legal action with a court, you are entitled to commence the out-of-court settlement of your dispute with us, provided that any such dispute between you and us has not been successfully settled directly. The institution in charge of out-of-court settlements with our company is the OnlineADR.cz (onlinemediator.cz/). More information on out-of-court settlements of consumer disputes may be found here (https://onlinemediator.cz/).
9.3Jurisdiction for disputes with Kiwi.com s.r.o. In cases of disputes with Kiwi.com s.r.o. the courts of the Czech Republic shall have complete jurisdiction over all disputes arising between you and Kiwi.com s.r.o. If you are a consumer and have your habitual residence in the EU, you may bring a claim to enforce your consumer protection rights in connection with the agreement governed by these Terms in the Czech Republic or in your country of residence, and proceedings may be brought against you only in the courts of your country of residence.
